Trailer To Go is an online intermediary only.
We provide technology that lets Owners list trailers and lets Customers and Drivers find, book, communicate about and pay for them. We are not the owner, lessor, hirer, bailee, carrier, transporter, agent, insurer or operator of any Trailer, and we do not take possession or control of any Trailer at any time.
Every rental is a separate contract directly between the Owner and the Customer (and, where delivery is used, involving the Driver). Trailer To Go is not a party to that contract. We do not guarantee the existence, quality, safety, roadworthiness, legality or availability of any Trailer, or the conduct, honesty or ability of any User.
You must be at least 18 years old and legally able to enter into contracts. You agree to provide accurate, current and complete information, to keep your login details secure, and to accept responsibility for all activity on your account. You may not impersonate anyone or create an account on another person's behalf without authority.
We may carry out identity, licence, vehicle or document checks on Owners and Drivers. These checks are for basic screening only. We do not warrant that any User is who they claim to be, that any document, licence, insurance or trailer detail is genuine, valid or current, or that any Trailer is roadworthy or lawful. Users must satisfy themselves before dealing with another User.
Owners are solely responsible for their listings, including descriptions, photos, dimensions, weight ratings, condition, availability, pricing, deposits and rules. By accepting a Booking, the Owner and Customer enter into a rental contract on the terms shown in the listing and any Rental Agreement, together with these Terms. The Customer must inspect the Trailer at handover and raise any issue before towing.
Customers and Drivers are solely responsible for holding the correct, valid driver's licence for the vehicle and Trailer combination, for ensuring the towing vehicle is suitable and within its legal towing capacity, and for towing safely and in compliance with all traffic and road-safety laws. Any licence-eligibility guidance shown on the Platform is a convenience only and does not replace your own legal responsibility. Towing without the correct licence or beyond legal limits is at your own risk and liability.
The Owner is solely responsible for ensuring each Trailer is roadworthy, lawfully registered and licensed, correctly described, safe to tow, and free of undisclosed defects, and for honouring confirmed Bookings. Trailer To Go does not inspect trailers and gives no warranty about their condition. If a Trailer is unsafe or misdescribed, that is a matter between the Owner and the Customer/Driver.
Unless a specific insurance product is expressly stated in writing to apply to a Booking, Trailer To Go does not provide insurance of any kind. Owners are responsible for insuring their own trailers as an asset. Customers and Drivers are responsible for ensuring they have appropriate cover (including their own vehicle insurance and any cover required for towing) before taking possession of a Trailer. Where a Booking uses delivery or collection, the parties agree that suitable insurance must be in place, and the absence of cover is at the risk of the User concerned, not Trailer To Go.
Drivers act as independent contractors providing delivery/collection between an Owner and a Customer. Drivers are not employees or agents of Trailer To Go. While a Trailer is in a Driver's possession, the Driver is responsible for it and for towing it safely and lawfully, and clause 9 (damage, loss, theft) applies to the Driver in the same way as to a Customer. Handover and return should be recorded (photos/condition notes) by the parties.
Towing and using trailers carries inherent risks. To the fullest extent permitted by law, you voluntarily assume all such risks and you release Trailer To Go, its owners, directors and staff from all claims, demands and damages arising out of or connected with any Trailer, any Booking, any towing, any delivery/collection, or any dealing between Users.
To the fullest extent permitted by South African law:
You agree to indemnify and hold harmless Trailer To Go, its owners, directors and staff against all claims, liabilities, losses, damages, penalties, fines and costs (including reasonable legal costs) arising from or connected with your listings, your Trailer, your Booking, your towing or delivery, your breach of these Terms or of any law, or your dealings with another User.
The Customer or Driver in possession of a Trailer is responsible for all traffic fines, toll charges, impound fees and any loss or injury caused to third parties during the Rental Period. Trailer To Go is not liable for any such amounts or claims and may pass on identifying information as required by law.
Cancellations and refunds are governed by the cancellation rules shown at the time of Booking and any applicable Owner policy. Service fees are generally non-refundable. Refund disputes are between the Owner and Customer; Trailer To Go may facilitate but does not guarantee any outcome.
Only completed transactions may generate reviews. Reviews must be honest and lawful; we may remove reviews that breach our rules. Disputes about a rental are primarily between the Users involved. Trailer To Go may, at its discretion, provide records or informal facilitation, but is not an arbitrator, adjudicator or guarantor and accepts no liability for the outcome.
We may suspend or terminate any account, and remove any listing, at our discretion — including for suspected fraud, safety concerns, or breach of these Terms — without liability to you.
The Platform, its branding, design and content are owned by Trailer To Go or its licensors and may not be copied or used without permission. You grant us a licence to display listing content you submit for the purpose of operating the Platform.
We may update these Terms from time to time. The current version is always available on the Platform, and continued use after changes take effect constitutes acceptance.
These Terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction. Nothing in these Terms excludes, restricts or waives any right or remedy you have under the Consumer Protection Act 68 of 2008, the Protection of Personal Information Act 4 of 2013 (POPIA), or any other law, to the extent those rights cannot lawfully be excluded. If any clause is found unenforceable, the rest remain in force.
